These Terms & Conditions ("Terms") govern your access to and use of www.dodtcsd.com (the "Site") and any products, services, courses, content, or communications offered by DoD Training Center San Diego ("DoD Training Center," "we," "us," or "our") (collectively, the "Services"). Please read them carefully.

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Services.

1. Eligibility & Acceptance

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services or enroll in a course. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete.

2. Changes to These Terms

We may modify these Terms at any time. Revised Terms become effective when posted, and we will update the "Last Updated" date above. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.

3. Permitted Use & Prohibited Conduct

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes in accordance with these Terms. You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose;
  • Violate any applicable law, regulation, or third-party right;
  • Copy, reproduce, scrape, harvest, record, or republish any part of the Services — including courseware, lab materials, slide decks, and recordings — without authorization;
  • Share course access credentials or distribute course materials to anyone who has not paid for the applicable course;
  • Introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to our systems;
  • Use any technique, tool, or lab environment provided during training against any system you are not expressly authorized to test;
  • Interfere with or disrupt the integrity, security, or performance of the Services;
  • Use automated means (bots, crawlers) except as permitted by our robots.txt;
  • Impersonate any person or entity or misrepresent your affiliation;
  • Use the Services to transmit unsolicited or unauthorized advertising or spam.

4. Course Enrollment, Cancellation & Rescheduling

A seat is reserved when payment is received or a purchase order or funding authorization is accepted in writing. Course dates, times, locations, and instructors are subject to change; we will notify enrolled students of any change as far in advance as practicable.

  • Student cancellation 14 or more days before the course start date: full refund of tuition paid.
  • Student cancellation fewer than 14 days before the course start date: no refund. You may request one complimentary transfer to a later cohort of the same course, subject to seat availability, by contacting us before the course start date.
  • No-show: a student who does not attend and does not notify us before the course start date forfeits tuition and any transfer privilege.
  • Cancellation by DoD Training Center: if we cancel or reschedule a course, you may transfer to another cohort at no charge or receive a full refund of tuition paid for that course. We are not responsible for travel, lodging, time off, or other incidental costs.

Exam vouchers, digital courseware, and other third-party materials that have been issued, delivered, or redeemed are non-refundable once released, regardless of the cancellation window.

5. Certifications, Exams & No Guarantee of Results

Our courses prepare you for industry certification examinations administered by independent certifying bodies, including but not limited to CompTIA, ISC2, ISACA, EC-Council, and Cisco. We are not those organizations, we do not control their exams, exam content, scoring, policies, pricing, or eligibility requirements, and we do not issue their certifications.

We do not guarantee that you will pass any examination, obtain any certification, receive any security clearance, or obtain employment or advancement of any kind. Outcomes depend on your own preparation, performance, and factors outside our control. Any pass rates, statistics, or student outcomes described on the Site are historical and are not a promise of your result.

Certification names, logos, and trademarks referenced on the Site belong to their respective owners and are used for identification only. Their use does not imply endorsement or affiliation unless expressly stated.

6. Orders, Shipping & Risk of Loss

All merchandise orders are subject to acceptance and product availability. Risk of loss and title for products purchased from us pass to you upon our delivery to the shipping carrier. Estimated delivery dates are not guaranteed. We are not responsible for delays caused by the shipping carrier, customs, or events outside our control.

7. Returns, Refunds & Exchanges (Merchandise)

Merchandise may be returned within 30 days of delivery. To request a return or exchange, contact us at info@dodtcsd.com within that window. Items must be unused, in the same condition you received them, and in their original packaging. Refunds are issued to the original payment method within 10 business days of our receiving and inspecting the returned item. Return shipping is the customer's responsibility unless the item arrived damaged or we shipped the wrong item. Gift cards, exam vouchers, and digital or downloadable materials are final sale unless required otherwise by law. See our Refund and Returns Policy for the full procedure. Course tuition is governed by Section 4, not by this section.

8. Sales Tax

We collect sales tax on orders shipped to states where we are required to do so by law. The applicable tax rate is calculated at checkout based on the shipping address.

9. Promotional Codes

Discount and promotional codes are subject to the terms stated at the time of issuance, may not be combined unless explicitly stated, have no cash value, and may be modified or discontinued at any time.

10. Accounts & Registration

Some features may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

11. Pricing & Payment

Descriptions, pricing, and availability of products, courses, and services are subject to change without notice. We strive for accuracy but do not warrant that descriptions, pricing, or other content are error-free. We reserve the right to refuse or cancel any order or enrollment, correct pricing errors, and limit quantities or seats.

We accept major credit and debit cards through our payment processor, Square. You authorize us and our payment processor to charge your selected payment method for the full order total, including applicable tax and shipping. If a payment is declined, charged back, or reversed, we may suspend or cancel the related order, enrollment, or account privileges.

12. Intellectual Property

The Services and all content, features, and functionality — including courseware, lab guides, slide decks, exercises, text, graphics, logos, images, designs, software, and trademarks — are owned by or licensed to DoD Training Center San Diego and are protected by U.S. and international copyright, trademark, and other intellectual-property laws. Course materials are licensed to you for your own personal study only and may not be copied, resold, shared, or used to deliver training to others. Except for the limited license granted in these Terms, no rights are transferred to you. You may not use our name, logos, or trademarks without our prior written consent.

13. User Content & Submissions

If you submit reviews, comments, photos, or other content ("User Content"), you retain ownership but grant DoD Training Center San Diego a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, modify, display, and distribute that User Content in connection with the Services and our business. You represent that you own or control all rights to your User Content and that it does not violate these Terms or any third-party rights.

Reviews and testimonials you submit may be displayed publicly on the Site and shared on our social channels. We may moderate or remove content that violates these Terms.

Classroom photography: we may photograph or record classes for promotional purposes. If you do not wish to appear in such material, tell your instructor before class begins and we will accommodate the request.

14. Third-Party Links & Services

The Services may contain links to or integrations with third-party websites, products, or services that we do not control, including certifying bodies and exam scheduling providers. We provide these for convenience only and do not endorse and are not responsible for their content, policies, or practices.

15. Disclaimers of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, DOD TRAINING CENTER SAN DIEGO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY OR REPRESENTATION THAT ANY COURSE WILL RESULT IN A PASSING EXAM SCORE, A CERTIFICATION, A CLEARANCE, EMPLOYMENT, OR ANY PARTICULAR CAREER OUTCOME. TRAINING CONTENT IS PROVIDED FOR EDUCATIONAL PURPOSES AND IS NOT LEGAL, COMPLIANCE, OR SECURITY-ASSURANCE ADVICE FOR ANY SPECIFIC SYSTEM OR ORGANIZATION.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DOD TRAINING CENTER SAN DIEGO OR ITS OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

17. Indemnification

You agree to indemnify, defend, and hold harmless DoD Training Center San Diego and its owners, officers, employees, instructors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, your use of any technique or tool taught in a course, or your violation of these Terms or any law or third-party right.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 19, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction and venue there.

19. Arbitration & Class-Action Waiver

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring a claim in small-claims court. You and DoD Training Center San Diego agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by notifying us in writing at info@dodtcsd.com within 30 days of first accepting these Terms.

Nothing in this section limits any right you may have under federal or state law that cannot be waived by agreement.

20. Termination

We may suspend or terminate your access to the Services, or remove you from a course, at any time, with or without notice, for any reason, including violation of these Terms or conduct that disrupts a class. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.

21. Miscellaneous

  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
  • No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our consent; we may assign them freely.
  • Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Headings. Section headings are for convenience only and have no legal effect.
